What Is a Conservator?
A conservator is a person who is appointed by the court to manage the financial and legal affairs of an elderly or mentally incapacitated person. The conservator is given the authority to make important decisions about the person's financial and legal affairs. The conservator is accountable to the court for all decisions made and must provide regular reports.
Some of the responsibilities of a conservator include:
- Managing the financial affairs of the person under conservatorship.
- Deciding where the person under conservatorship will live.
- Deciding what medical care the person under conservatorship will receive.
- Deciding how the person under conservatorship will spend money.
The court may also appoint a separate guardian to make decisions about the person's personal and health care needs. The conservator and guardian may be the same person.
Who Is Eligible for a Conservatorship?
A conservatorship may be necessary when a person is no longer able to make decisions about their health and financial affairs due to old age or mental illness. A conservator may be appointed for a person who is an adult or is a minor who is legally emancipated. The person may be an elderly person who is unable to pay bills or maintain their home.
Some of the reasons a court may appoint a conservator for a person include:
- Aging
- Mental illness
- Alzheimer's disease
- Dementia
- Paraplegia
- Paralysis
- Brain injury
- Parkinson's disease
- Muscular dystrophy
- Other physical disabilities
In rare cases, a person may also become incapacitated if they are intoxicated or under the influence of drugs. A conservator may also be appointed if a person is deceased and there are no known heirs or the known heirs are unable to care for the estate. A conservator may be appointed for a minor who is not emancipated if there are no known guardians or the known guardians are unable to care for the minor's affairs.
